SUPREME COURT PETITIONED TO ALLOW SUITS BY ACTIVE MILITARY PERSONEL

A recent AAJ article reports that a petition is pending requesting that the Supreme Court allow active duty military personnel to sue the government. Petty Officer Nathan Hafterson died on March 26, 2006, at Naval Hospital Jacksonville after being admitted for trouble breathing. His attorneys state that it would put military members on the same footing as civilians under the Federal Tort Claims Act. This malpractice action was denied by the lower courts because a federal law (known as the Feres doctrine) prohibits active military members from suing the US government. Paul Becker

TRUCK RELATED FATALITIES DECLINED IN 2008

Movinout.com a national journal of the trucking industry reports in its August 2009 edition that in the year 2008 truck related fatality rates declined by 12% as reported by the National Highway Traffic Safety Administration. The number of truck occupant deaths also decreased 16%. Further the overall number of people killed in motor vehicle crashes in the US decreased almost 10%, the lowest level since 1961.The decrease is attributed in part to the increased use of safety belts along with new hours-of-service regulations.

Truck fatalities are now at their lower point since statistics have been kept starting in 1975. The American Trucking Association also credits its 18 point safety agenda which includes promoting safety belt use, a national speed limit, improved truck crash worthiness standards, tax incentives for safety technology, and drug testing. TEN THOUSAND FIREFIGHTERS HONOR FALLEN HEROS

The mourners from afar came to pay respects to Lt. Charles W. "Chip" McCarthy Jr. and Firefighter Jonathan S. Croom early Monday. Both rushed into a burning building to rescue a life -- any life -- from the smoky hell.
The firefighters created created a profoud scene for McCarthy as his casket reached the historic St. Joseph Cathedral shortly before 10 this morning. The casket and McCarthy's family entered the cathedral through a path of firefighters at least ten deep.
As McCarthy's family members followed his flag-draped wooden coffin into the cathedral, not firefighters stood in respect, and workers from nearby office buildings gazed attentively from their windows or came outside to join in tribute.See Buffalo News. John Feroleto

True Heros

Buffalo firefighters hung drapes of mourning outside two firehouses on Jefferson Avenue and Main Street on Monday, out of respect for Lt. Charles W. "Chip" McCarthy Jr. and Firefighter Jonathan S. Croom.

As reported in the Buffalo News "But the black and dark blue bunting was only one of the signs that fellow firefighters were just beginning to come to terms with their loss.

Eyes were rimmed red from tears, stories about McCarthy and Croom from happier times made the rounds, and colleagues collected personal effects from their fallen comrades during the early hours of grief." Members of the close knit firefighters community and the region are morning the loss of two heros. John Feroleto

Hudson plane-helicopter crash- preventable fatal tragedies continue

According to the New York Times "Roughly 15 years ago, the federal agency that investigates air disasters(NTSA) made a plea for more data on the air-tour industry, to improve safety for helicopter, airplane, balloon and airship flights around the nation. Six years later, it asked again." Preventable fatal tragedies continue.

"Deborah A. P. Hersman, the safety board chairwoman, in an interview Thursday sharply criticized a process that, she said, sometimes takes “2 years, 4 years, 10 years” to see the board’s recommendations achieved.'We issue them because we think they can save lives and improve safety,' Ms. Hersman said of the board’s recommendations. The board does not have the authority to carry out or enforce its recommendations." John Feroleto

AIR TRAFFIC IN A TUNNEL

In a New York Times article "Steven J. Korotky, a flight instructor, called the uncontrolled Hudson River air traffic corridor a “tunnel,” and a tight one at that.Kenneth Jacobsen, who has been flying privately chartered helicopters in New York since 1982, said that while he considered aviation safe in the congested skies above the river, there could be a dozen or so aircraft to contend with at peak moments."

The fact is nine people including 5 Italian tourist celebration a 25th wedding aniversary died needlessly in the airplane helicopter crash. The DOT has called for action as the privately chartered aircraft are less regulated and less safe than major carriers. John Feroleto

Pinnacle President admits Flight 3407 pilot should not have been flying

A recent Buffalo News article reported that the President of Pinnalce Airlines admitted that the pilot in this crash should not have been flying. The pilot of that plane, Capt. Marvin Renslow, had failed three federal "check rides" before Colgan hired him. The article reported that Colgan never double-checked with federal officials to see whether Renslow's application -- which listed only one failed check ride -- had revealed his complete test record. The presidents admission came at a hearing of the Senate Aviation Subcommittee. It was determined that Renslow reacted inappropriately to a stall warning, doing exactly the opposite of what he should have done to correct the plane's course.

TEXTING WHILE DRIVING BILL SPONSORED

The New York Times reported July 30, 2009 that Charles E. Schumer, along with three other Senators are sponsoring a bill to curb texting while driving. The legislature in New York recently passed such a measure and sent it to the governor for a signature. Currently texting while driving is banned only in 14 states. Studies have shown that it is at least as dangerous as drinking and driving. The federal bill would exert pressure on States by withholding federal highway funds if they do not outlaw texting and emailing while driving.
